Terms of Service and EULA

The service
Glidepath is an operations platform for military airfields and Part 139 airports, provided by Glidepath Technologies, LLC.
These terms cover your organization's use of the Glidepath application and this website. The full agreement is also presented in the application on first sign-in and at app.glidepathops.com/terms.
Not a Department of Defense product
Glidepath is commercial software. It is not a product of the Department of Defense, the Department of the Air Force, the Air National Guard, or any other U.S. government organization, and it is not endorsed, certified, or approved by any of them.
Glidepath Technologies, LLC and anyone associated with the company, including in a personal or military capacity, do not authorize, direct, or approve any unit or workplace to use the software. That decision belongs to the user and their chain of command.
No Authority to Operate
Glidepath does not have a DoD Authority to Operate, a FedRAMP authorization, or a DoD Cloud Computing SRG impact-level authorization. It is not an authorized DoD information system.
Do not store CUI
You may not enter Controlled Unclassified Information into Glidepath. Under 32 CFR 2002.4(h), CUI is information the U.S. Government creates or possesses (or that a non-federal entity creates or possesses for or on behalf of the Government) that a law, regulation, or Government-wide policy requires or permits an agency to safeguard or restrict. Both parts must be true, and the type must appear in the National Archives CUI Registry. There is no aggregation rule.
Accounts and acceptable use
Access to the Glidepath application is limited to the authorized users your organization invites.
Use the platform only for its intended purpose. Do not misuse it, interfere with it, or try to access records your account is not permitted to see.
Your records
Your organization owns the records it enters into Glidepath: status updates, inspections, discrepancies, training history, and everything else. Glidepath stores and serves those records; it does not own them.
Records exports are available on request.
Glidepath supports your decisions, it does not make them
Glidepath records and organizes the work your organization already performs. It does not operate the airfield or airport, and it is not a substitute for the judgment of the people who do.
Responsibility for the safety of the movement area, for what gets closed or opened, for what is reported, and for compliance with every regulation that applies to your organization stays with your organization and its chain of command. Where the platform references a regulation, that reference is a convenience: the governing regulation, order, or advisory circular is the authority, and it controls if the two ever differ.
Do not rely on Glidepath as the only source for a safety-of-flight decision. If the platform is unavailable, or a record looks wrong, fall back to your organization's established procedures.
Availability and support
Before your organization is under a signed contract with Glidepath, the site and application are provided as they are, with no uptime commitment and no committed support response. Access may change, pause, or end without notice during this period.
Glidepath may update, change, or retire features as the platform develops. Where a change would remove something your organization depends on, we will make a reasonable effort to tell you before it happens.
Once a contract is in place, its terms govern availability, support, and everything else it addresses, and those terms supersede this page wherever the two overlap.
Warranties
Except where a signed contract with your organization says otherwise, Glidepath is provided as it is and as available, without warranties of any kind, whether stated outright or implied. That includes any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
Glidepath does not warrant that the platform will be uninterrupted, error free, or secure against every threat, that defects will be corrected, or that the platform will meet a particular regulatory or accreditation requirement your organization is subject to.
Some jurisdictions do not allow certain warranties to be excluded. Where that is the case, the exclusions above apply only as far as that jurisdiction permits.
Limitation of liability
To the maximum extent the law allows, Glidepath Technologies, LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or the cost of substitute services, arising out of or relating to your use of the platform, even if we have been advised that such damages are possible.
To the maximum extent the law allows, the total liability of Glidepath Technologies, LLC arising out of or relating to the platform is limited to the amount your organization paid us for the platform in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if your organization has paid us nothing.
These limits do not apply to liability that cannot be limited by law, and they do not limit anything a signed contract between your organization and Glidepath expressly provides. Some jurisdictions do not allow these limits, and where that is the case they apply only as far as that jurisdiction permits.
Your organization's responsibility for its use
Your organization is responsible for what its users enter into the platform, for keeping account credentials secure, and for the decisions made using the records the platform holds.
To the extent the law allows and your organization is permitted to agree to it, your organization will cover claims brought against Glidepath Technologies, LLC that arise from its misuse of the platform, from entering material these terms prohibit, such as Controlled Unclassified Information, or from its violation of these terms. Where your organization is a government entity that cannot agree to such a commitment, this section does not apply to it.
Changes to these terms
These terms may change as the platform develops. The current version always appears here and in the application, with the date it was last updated at the top.
Where a change materially affects your organization's rights, we will make a reasonable effort to give notice through the application or by email before it takes effect. Continuing to use the platform after a change takes effect means the updated terms apply.
